Read This First

These Terms form a binding agreement between you and Effectuatem. By selecting Continue, signing in with Google, starting a trial, purchasing a subscription, or using the Service, you accept them.

If you do not agree with these Terms, do not continue, create or access an account, purchase a subscription, or use the Service.

01. Scope and Acceptance

These Terms of service (“Terms”) govern your access to and use of the Effectuatem mobile application, its account system, subscription features, content, support and related services (collectively, the “Service”). “Effectuatem”, “we”, “us” and “our” refer to the provider of the Service, operating from Jammu and Kashmir, India.

You accept these Terms when you select the primary Continue button where the Terms notice is displayed, sign in with Google to create or access an Effectuatem account, start a free trial, purchase a subscription, restore a purchase, or otherwise use the Service. The Privacy Policy is incorporated by reference for information about how personal data is handled.

If you do not agree with these Terms, you must not continue or use the Service. Existing users who do not accept a material update may lose access to normal app functionality, but may still use available paths to review legal documents, contact support, manage Google Play billing and request account deletion.

Acceptance records may include the account identifier, Terms version, Privacy Policy version, app version, acceptance method and server-recorded date and time. Earlier versions may be archived and may continue to govern events that occurred while they were effective.

02. Eligibility

You must be at least 18 years old and legally capable of entering a binding agreement to create an account, start a trial, purchase a subscription or use the Service. Persons under 18 must not access or use Effectuatem.

By continuing, you represent that the eligibility information you provide is truthful and that you have legal capacity to accept these Terms. Effectuatem may restrict, suspend or terminate an account where it reasonably believes that eligibility information is false, misleading or used to evade an age restriction.

The Service is initially intended for users in India. Access from another location does not mean that the Service is offered, lawful or supported there. You are responsible for complying with laws applicable to your location.

03. Account Creation and Security

Google Sign-In

Effectuatem uses Google Sign-In as the account authentication method. To create or access an Effectuatem account, you must sign in using an eligible Google account. Google authenticates the sign-in and may provide basic account information, such as your email address, display name, profile image and provider identifier, as described in the Privacy Policy. Effectuatem does not receive or store your Google password.

Your Effectuatem Account

Your Effectuatem account is associated with the Google account used to sign in.

One Person; No Transfer

Each account and subscription is personal to one user. You must not sell, rent, share, sublicense, assign or transfer an account, workspace or subscription to another person. Effectuatem may restrict simultaneous, fraudulent or abusive use across accounts or devices.

Your Security Responsibility

You are responsible for maintaining reasonable control of your device, Google account and Effectuatem account access, using available device and account security protections, and notifying Effectuatem promptly if you reasonably believe that access has been compromised.

Effectuatem remains responsible for applying reasonable safeguards to systems under its control.

Multiple Accounts and Abuse

You must not use multiple Google accounts or Effectuatem accounts to obtain repeated trials, avoid payment, bypass limits, evade suspension, interfere with enforcement or commit fraud.

Effectuatem may investigate and restrict accounts where such misuse is reasonably suspected.

04. The Service and Subscription Requirement

Effectuatem is a productivity and task-management service designed to help users organise, create, update and manage tasks.

The Service does not guarantee that a user will complete a task, achieve a goal, become more productive, meet a deadline or obtain any personal, professional, financial, educational or health outcome. Users may complete onboarding and view limited parts of the interface without payment. Core functions, including task creation and task management, require an active paid subscription or an eligible active trial.
If no valid entitlement exists, Effectuatem may restrict access to paid functionality.
Plan names, included features, usage limits and support level are those displayed in the app and in the Google Play purchase flow at the time of purchase.

Features may differ between plans. Priority support means prioritised review where offered; it does not guarantee a response or resolution within a fixed time.
Version 1 does not provide an automated export or downloadable task archive. Users should not rely on Effectuatem as the only repository for critical, irreplaceable or legally required information.

05. Plans, Trials and Billing

Purchase Information

Monthly and annual subscription options may be offered.
The exact plan, price, currency, taxes, billing period, trial eligibility, renewal date and post-trial charge shown by Google Play before confirmation control the purchase. Effectuatem will not charge you outside the authorised Google Play purchase flow for an Android subscription.

Free Trial

An eligible plan, including a Power Plan offer where available, include a 7-day free trial. Eligibility is determined by the applicable offer and Google Play account. Unless cancelled before the trial ends, the subscription automatically converts to the paid plan at the price and billing period shown before the trial starts.

Automatic Renewal

Subscriptions renew automatically at the start of each billing cycle unless cancelled. Google Play processes payment methods, authorisations, renewals, taxes, receipts and billing records. You are responsible for reviewing the purchase screen and ensuring that the selected plan and payment method are correct.

Price and Plan Changes

Effectuatem may change plan features or prices prospectively. Material changes will be communicated as required through the app, email where available, Google Play or another appropriate method. Changes to an existing subscription are handled according to Google Play procedures and applicable law.

Payment States

Access may remain active during a recognised trial, paid period or Google Play grace period. Access may be restricted while a purchase is pending, during account hold, after an unsuccessful renewal, after expiry, or when Google Play reports a refund, revocation, chargeback or invalid entitlement.
Effectuatem may re-check entitlement status before unlocking paid features.

06. Cancellation, Refunds and Restoration

Managing or Cancelling

Subscriptions are managed through Google Play. The app provide a Manage Subscription button that opens Google Play’s subscription-management page.

Cancellation normally stops future renewal and does not immediately end access; the user generally retains access until the end of the current paid or trial entitlement period, subject to Google Play rules and applicable law. Uninstalling Effectuatem or deleting an Effectuatem account does not automatically cancel a Google Play subscription.
You must separately manage or cancel billing through Google Play to prevent future renewal.

Refunds

Refund eligibility is determined under Google Play policies, Effectuatem’s stated refund position and applicable consumer law. Users may request a refund through Google Play.
Requests that Google Play directs to the developer may be reviewed by Effectuatem support on a case-by-case basis, including where a confirmed technical failure prevented delivery of the paid service, a duplicate charge occurred, or applicable law requires a remedy.

Cancellation alone does not create a refund for the current billing period.
A refund, partial refund, chargeback or purchase revocation may result in immediate or later removal of the corresponding entitlement. Nothing in these Terms limits a mandatory statutory refund or consumer remedy.

Restore Purchase

The Restore Purchase function checks for an eligible Google Play entitlement and does not normally create a second charge. Restoration may restore eligible subscription access. It does not restore information that was previously deleted, and it does not transfer data between different Effectuatem accounts.

07. Limited Software Licence

Subject to these Terms and any applicable subscription requirement, Effectuatem grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to install, access and use the Service for lawful personal productivity purposes. The licence does not transfer ownership of Effectuatem, its source code, object code, interface, design system, brand, documentation, databases or other intellectual property.

All rights not expressly granted are reserved.

The licence automatically ends when your account is permanently terminated, when you cease to meet the eligibility requirements, or when these Terms otherwise permit access to be withdrawn.
Sections that by their nature should survive termination will continue to apply.

08. User Content and Feedback

Ownership of Tasks

You retain ownership of task titles, descriptions, feedback and other content that you create and submit through the Service (“User Content”). You are responsible for ensuring that you have the right to submit that content and that it does not violate law or another person’s rights.

Operational Licence

You grant Effectuatem a limited, worldwide, non-exclusive and royalty-free licence to host, store, reproduce, process, transmit and display User Content only as reasonably necessary to operate, secure, maintain and support the Service. This licence ends when the relevant content is deleted, subject to temporary technical copies and lawful retention described in the Privacy Policy.

Feedback and Ideas

If you submit a feature request, suggestion or product idea, you grant Effectuatem a perpetual, worldwide, non-exclusive, royalty-free licence to evaluate, adapt and use the idea without an obligation to implement it or compensate you. Effectuatem may use de-identified feedback to improve or describe the Service. Identifiable testimonials will not be publicly attributed to you without appropriate permission.

Sensitive or Third-Party Information

Effectuatem is not designed as a password manager, medical record system, financial vault or secure repository for highly sensitive secrets. You must not enter another person’s confidential, personal or proprietary information unless you are authorised to do so.

09. Prohibited Conduct

You must not use, attempt to use, or assist another person to use the Service in a way that:

  • Violates any applicable law, court order, regulation or third-party right.
  • Facilitates fraud, impersonation, phishing, unauthorised access, harassment, exploitation or other harmful activity.
  • Uploads, stores or transmits malware, malicious code, stolen credentials, unlawfully obtained information or content that infringes intellectual-property, privacy or confidentiality rights.
  • Reverse engineers, decompiles, disassembles, translates, modifies, copies or attempts to derive the source code or underlying structure of the Service, except where a non-waivable law expressly permits it.
  • Probes, scans, tests or attacks security without prior written authorisation.
  • Scrapes, crawls, automates, overloads, disrupts or interferes with the Service, infrastructure or another user.
  • Circumvents a paywall, subscription control, usage limit, trial restriction, suspension, access rule or security mechanism.
  • Resells, rents, shares, sublicenses or commercially exploits the Service or subscription without written permission.
  • Uses multiple accounts or manipulated purchase states to obtain benefits not legitimately available.
  • Misrepresents age, eligibility, identity, entitlement or authority.
  • Copies or uses the Effectuatem name, logo, interface or protected materials in a misleading or unauthorised manner.

Effectuatem may investigate suspected misuse, preserve relevant evidence, restrict functionality and cooperate with lawful requests where reasonably necessary.

10. Intellectual Property

Effectuatem and its licensors retain all rights, title and interest in the Service, including software, source code, interface, design, layout, brand, logos, text, graphics, documentation, databases, product systems, updates and related intellectual-property rights.

Third-party software, fonts, libraries, icons and other materials remain owned by their respective rights holders and are used under applicable licences. Nothing in these Terms transfers third-party rights to you.
You may not use the Effectuatem name, logo or branding in a way that suggests endorsement, partnership or ownership without prior written permission.

11. Service Changes and Availability

Effectuatem may add, change, limit, suspend or remove features, interfaces, plan benefits or technical requirements to improve the Service, address security, comply with law, respond to platform changes or maintain commercial viability.

Material changes affecting an active paid plan will be handled prospectively and with notice where required. The Service may be temporarily unavailable because of maintenance, updates, security action, outages, infrastructure failures, payment-system failures, internet connectivity, device compatibility, force majeure or other circumstances. Advance notice may be provided where practical, but emergency interruptions may occur without notice. Effectuatem does not guarantee uninterrupted, error-free, permanently available or universally compatible operation. Support is provided on a reasonable-efforts basis without a guaranteed response or resolution time.

12. Account Deletion

User-Requested Deletion

You may request deletion of your Effectuatem account through Settings > Delete Account in the app or through the external Account Deletion page on the official Effectuatem website. A website request may require the email address associated with the Google account used for Effectuatem and reasonable verification before deletion is carried out. Effectuatem will not ask for your Google password.
Account deletion is permanent.
Account-linked information will be deleted or irreversibly disassociated as described in the Privacy Policy, except for limited information that may lawfully be retained for security, fraud prevention, accounting, disputes or other legal obligations.

Subscription Billing Is Separate

Deleting an Effectuatem account does not cancel Google Play billing. If you do not want a subscription to renew, you must separately cancel or manage it through Google Play.

13. Suspension and Termination

Effectuatem may temporarily restrict or suspend an account where it reasonably suspects a Terms violation, security threat, fraudulent payment, abusive conduct, unlawful activity, entitlement manipulation, false eligibility information or risk to users, the Service or third parties.

During a temporary suspension, Effectuatem may preserve account data while restricting task access pending investigation. The user may contact support to correct an error or appeal. The user must still manage subscription billing separately through Google Play and may use available account-deletion controls.

Effectuatem may permanently terminate an account for serious, repeated or unresolved violations, legal requirements, confirmed fraud, attacks on the Service, intellectual-property infringement or conduct creating material risk. Where practical and lawful, Effectuatem may provide notice of the reason.

Termination does not create an automatic refund and does not cancel Google Play billing. Limited security, fraud, enforcement, transaction or dispute records may be retained as described in the Privacy Policy and as permitted by law.

14. Privacy and Electronic Communications

Effectuatem’s Privacy Policy explains what information is collected through Google Sign-In and use of the Service, why it is used, how it may be shared, retention practices, account deletion and available privacy rights.

These Terms do not replace the Privacy Policy. You agree that essential service communications may be delivered electronically through the app, the email address associated with your account, a support email address you provide, or another reasonable method.

These communications may include Terms and Privacy Policy updates, subscription and trial notices, price-change notices, security alerts, suspension or termination notices, support responses and legally required notices. Essential service communications are not promotional marketing. Where marketing is introduced, any legally required choice or consent will be handled separately.

15. Third-Party Services

The Service may depend on third-party app stores, authentication services, billing systems, communications networks, operating systems and infrastructure. Their own terms, privacy practices, availability and technical rules may apply. Effectuatem does not control every third-party outage, policy change, payment decision or account action. Android subscriptions are purchased and managed through Google Play. A dispute concerning a payment method, Google account, store refund, tax, receipt or store authorisation may also require contact with Google Play. A third-party failure does not excuse Effectuatem from obligations that applicable law places directly on Effectuatem, but may affect the timing or technical availability of the Service.

16. Disclaimers

To the maximum extent permitted by law, the Service is provided on an “as available” basis. Effectuatem makes no guarantee that every feature will always be available, that every error will be corrected immediately, or that the Service will meet every individual requirement. Effectuatem is a task-management tool, not professional advice. It does not provide medical, mental-health, legal, financial, employment or educational advice. Decisions, deadlines, commitments and outcomes remain the user’s responsibility.

Effectuatem does not guarantee task completion, discipline, productivity, income, grades, business results, improved health, reduced stress or achievement of any goal.

Examples, onboarding language and progress displays are informational and do not constitute a promise of results. Although reasonable safeguards and operational measures may be used, Effectuatem does not guarantee that data loss, corruption, unauthorised access, device failure or interruption can never occur. Users should not treat the Service as the sole copy of critical or irreplaceable information.
Nothing in this section excludes warranties, guarantees or remedies that cannot lawfully be excluded under applicable consumer law.

17. Limitation of Liability

To the maximum extent permitted by law, Effectuatem will not be liable for indirect, incidental, special, exemplary, punitive or consequential loss, including loss of opportunity, profit, business, reputation, anticipated savings or data, arising from use of or inability to use the Service.

Effectuatem is not responsible for losses caused by inaccurate user input, or deadlines, device loss, unauthorised access to a user-controlled device or Google account, third-party service outages, failure to cancel a subscription, or use of the Service contrary to these Terms
Where Effectuatem is legally liable and liability may lawfully be limited, Effectuatem’s total aggregate liability arising from the Service will not exceed the subscription fees actually paid by the affected user to access Effectuatem during the 12 months immediately preceding the event giving rise to the claim.

The exclusions and cap do not apply to fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or any liability, statutory right or consumer remedy that cannot legally be excluded or limited.

18. Indemnity

To the extent permitted by law, you agree to defend, indemnify and hold Effectuatem harmless from a third-party claim, damage, penalty, cost or reasonable legal expense arising directly from:

  • Your unlawful or intentionally harmful use of the Service.
  • User Content that infringes another person’s intellectual-property, privacy or confidentiality rights.
  • Your fraud, impersonation, security attack, paywall circumvention or unauthorised commercial exploitation.
  • Your material breach of the prohibited-conduct provisions of these Terms.

This indemnity does not require you to compensate Effectuatem for loss caused by Effectuatem’s own unlawful conduct, gross negligence or wilful misconduct.

Effectuatem will provide reasonable notice of a covered third-party claim where practical.

19. Dispute Resolution and Governing Law

Step 1 – Direct Resolution

Before starting formal proceedings, the user should send the dispute to support@effectuatem.com with the account identifier, relevant dates, transaction details and a clear description of the requested resolution.
Both parties will attempt in good faith to resolve the matter within 60 days after sufficient information is received.

Step 2 – Voluntary Mediation

If the dispute remains unresolved, the parties may voluntarily attempt confidential mediation, including online mediation, through a mutually agreed independent mediator or mediation institution.
Unless otherwise agreed, each party bears its own costs and the mediator’s fees are shared equally.

Mediation does not prevent either party from seeking urgent relief where necessary to protect security, intellectual property or prevent immediate harm.

Step 3 – Lawful Remedies

If mediation is not used or does not resolve the dispute, either party may pursue remedies available under applicable law.
These Terms are governed by the laws of India.
Subject to mandatory consumer rights and rules that cannot be waived, courts of competent jurisdiction in Jammu and Kashmir will have jurisdiction.

Nothing in these Terms prevents a user from contacting a competent consumer authority, regulator, law-enforcement body or court where the law permits or requires it.

Mandatory consumer and statutory rights are preserved.

20. Changes to These Terms

Effectuatem may update these Terms to reflect legal, security, product, subscription, operational or business changes.
The updated version and effective date will be published through the app, website or another appropriate channel. Material changes affecting payment, user rights, content ownership, liability, dispute procedures, suspension or significant service obligations may require prominent notice or renewed acceptance before continued use.
Minor administrative, formatting or clarification changes may not require renewed acceptance.

The newest accepted version applies prospectively from its effective date.
Earlier versions may remain relevant to purchases, conduct or disputes that occurred while those versions were effective.

If you do not accept a required material update, you must stop using the Service, manage any subscription through Google Play and use the available account-deletion process.

21. General Legal Terms

Entire Agreement

These Terms, the Privacy Policy, the purchase terms displayed by Google Play and any plan-specific terms shown before purchase form the agreement concerning the Service.
If plan-specific purchase terms conflict with a general statement in these Terms, the more specific purchase term controls for that transaction, subject to applicable law.

Severability

If a provision is held invalid or unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect.

No Waiver

A delay or failure to enforce a provision is not a waiver of the right to enforce it later.
A waiver must be explicit and applies only to the specific matter stated.

Assignment

You may not assign or transfer your rights or obligations without Effectuatem’s written permission.

Effectuatem may assign these Terms to a successor or in connection with a lawful reorganisation, financing, acquisition or transfer of the Service, subject to applicable notice and user rights.

Force Majeure

Effectuatem is not responsible for delay or failure caused by circumstances beyond reasonable control, including natural disasters, war, civil disturbance, government action, internet or power failure, labour disruption, widespread cyberattack or failure of critical third-party infrastructure, provided that reasonable steps are taken where practicable.

Headings and Interpretation

Headings are for convenience and do not limit the meaning of a clause. “Including” means including without limitation.

The English version controls unless applicable law requires otherwise.

Survival

Provisions concerning payment obligations, intellectual property, content licences, disclaimers, liability, indemnity, disputes, retained records and any provision intended by its nature to survive will remain effective after suspension, termination or account deletion.
